Tip: How to Change Your Trust

Published: Tue, 11/04/14

Hi

With the changes that always happen in life, it is pretty common to need to change something in your trust about once every 10 years or so.  This could include having additional children you want to include or removing secondary trustees no longer able to do the job.  Or you could simply change your mind on one point or another.

The good news is you can change a Living Revocable Trust pretty simply.  You can either use an amendment for just a few changes, or use a Trust Restatement to replace the whole document.  The original name and date of your Living Revocable Trust stay the same, so you don't have to change any titling of the property you have put into that trust.  That property is still "owned" by the trust but will be governed by the new terms you create through the amendment or restatement.

More information on how to amend or restate your trust is available at http://www.legalees.com/change-trust/ and in my video at the top right of this email.
