Most business owners believe that having an LLC protects their assets from lawsuits.
But what if I tell you that you can still get sued personally and lose almost everything, even if you have an
LLC?
That’s right!
Case in point:
I had a California business guy who runs an ad agency in LA come to me a few years ago. This guy built his company under a partnership.
It’s a pretty big company with over a hundred employees. But as the company grew, they decided
they wanted to get some asset protection and turn their company into an LLC.
But instead of going to a lawyer who specializes in asset protection, they committed one of the biggest mistakes companies make when setting up an LLC. They went the “cheapest and easiest” route and assumed they were done once they had the paper.
It doesn’t matter whether you use the internet guys or lawyers, they only
get you halfway there.
About 3 months later, their ad agency did get sued. And when they got into court, it took about 15 minutes for the opposing team to say:
“Your Honor, we don’t have to honor this LLC. We can sue these guys personally.”
And the judge says, “Yeah, you’re right.”
Now, I won’t go into the nitty-gritty of how the case went, but it cost him a lot of money and caused a lot of stress.
So why didn’t his LLC protect him from getting sued?
